The former personal attorney for Donald Trump has resigned as New Jersey's top federal prosecutor. This follows a court battle that questioned her legal standing to serve.
Attorney General's Statement
The head of the Justice Department, Pam Bondi, announced the prosecutor's departure on Monday. She commented that the judicial decision made it impossible for Habba to lead the department effectively.
"But do not mistake compliance for surrender," Habba stated. "This battle will now extend throughout America."
Judicial Challenge
The departure comes a week after a US appeals court determined that she had been serving in violation of the law as the top prosecutor. This ruling is could influence many prosecutions in New Jersey.
The court ruled that a temporary posting that bypassed the advice and consent of the Senate ran afoul of the federal law governing appointments.
Ongoing Legal Battle
It was also stated that Habba will continue working within the DOJ as a top consultant. They intend to challenge the decision of the disqualification, in the hope of achieving a different outcome.
In a statement, the Attorney General wrote that the judiciary "cannot be permitted to override the executive's selection of prosecutors entrusted with executing the fundamental role of the presidency of prosecuting crime."
Record and Legacy
She praised her tenure and pointed out that under her leadership, the city of Newark saw a one-fifth decrease in criminal activity. It was also reported that the southern city of Camden recorded its first summer in half a century with no murders.
Background and Previous Role
Habba, 41, was initially recruited to Donald Trump's lawyers in recent years. Subsequently, she acted for her client in his New York criminal case in New York last year, when he was conviction on 34 counts of falsifying business records.
Prior to assuming the top New Jersey post, the former president had announced he was naming her as his presidential counsellor in a potential future term, calling the lawyer as deeply loyal and a relentless legal advocate.
